Important: each golfer needs their own email address. We use these addresses to match each player to their required waiver. If the captain is also playing, enter the captain's email as Player 1. Player 2, Player 3, and Player 4 must each use that golfer's own email address.

LIABILITY WAIVER AND RELEASE — PLEASE READ CAREFULLY

1. ACKNOWLEDGMENT OF RISK

I, the undersigned participant, acknowledge that participation in the 5th Annual Connected Through Cancer Foundation (CTCF) Golf Tournament involves inherent risks, including but not limited to: risks of injury from golf ball strikes, golf club usage, golf cart operation, uneven or hazardous terrain, weather conditions (including heat, lightning, and severe weather), insect or wildlife encounters, and the physical exertion associated with the game of golf. I understand that these risks cannot be eliminated without destroying the essential nature of the activity, and I voluntarily and freely choose to participate despite these risks.

2. ASSUMPTION OF RISK

I assume full responsibility for all risks of injury, death, or property damage arising from my participation in this event, whether occurring on or off the golf course premises, including the practice area, parking lot, clubhouse, dining area, and any other property associated with Gleannloch Golf Club or the event.

3. RELEASE AND WAIVER OF LIABILITY

In consideration of being permitted to participate in the 5th Annual CTCF Golf Tournament, I, on behalf of myself, my heirs, executors, administrators, assigns, and next of kin, hereby release, waive, discharge, and covenant not to sue Connected Through Cancer Foundation (EIN 83-1066048), Gleannloch Golf Club, their respective officers, directors, board members, employees, volunteers, agents, representatives, sponsors, and assigns (collectively, the "Released Parties") from any and all claims, demands, losses, causes of action, damages, or liability of any kind, whether in contract or tort, including but not limited to claims for personal injury, wrongful death, and survival claims, arising out of or related to any injury, illness, death, or property damage (including but not limited to broken bones, head or neck injury, spinal injury, paralysis, concussion, heart attack, heat stroke, or death) that I may suffer as a result of my participation in this event, whether caused by the negligence of any Released Party or otherwise, to the fullest extent permitted by law. This Release does not apply to claims arising from the gross negligence (as defined under Texas Civil Practice and Remedies Code § 41.001(11)), willful misconduct, or intentional acts of any Released Party.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or resulting from my acts or omissions during the event, including any injury caused to a third party by my golf ball, golf club, golf cart operation, or other conduct.

5. MEDICAL AUTHORIZATION

In the event of injury, illness, or medical emergency during the event, I authorize the Released Parties and their representatives to arrange for or administer first aid, medical treatment, or emergency transportation as they deem necessary. I agree to be financially responsible for any medical or emergency services rendered.

6. ALCOHOL AND BEVERAGE CONSUMPTION

I acknowledge that alcoholic beverages may be available at the event. I represent that I am of legal drinking age and agree to consume any alcoholic beverages responsibly. I agree that the Released Parties are not liable for any injury, damage, or legal consequence arising from my consumption of alcohol during or after the event. I will not operate a golf cart or motor vehicle if impaired.

7. PHOTO, VIDEO, AND MEDIA RELEASE

I grant to Connected Through Cancer Foundation and its designees the irrevocable right to use my name, likeness, photograph, video image, and voice recordings taken during the event for any lawful purpose, including but not limited to promotional materials, social media, websites, newsletters, press releases, and fundraising campaigns, without further compensation or additional authorization.

8. PERSONAL PROPERTY

I acknowledge that the Released Parties are not responsible for any personal property that is lost, stolen, damaged, or destroyed during the event, including property left in vehicles, golf carts, the clubhouse, or on the course. I am solely responsible for securing my belongings.

9. GOLF CART AND EQUIPMENT USE

If I operate a golf cart or use any golf equipment during the event, I agree to do so in a safe and responsible manner, to follow all course rules and instructions provided by Gleannloch Golf Club staff, and to accept full responsibility for any damage to the cart, equipment, the course, or any person or property resulting from my operation or use.

10. CONDUCT AND COMPLIANCE

I agree to conduct myself in a respectful and sportsmanlike manner throughout the event and to comply with all event rules, course rules, and directives from event organizers and Gleannloch Golf Club staff. I understand that the Released Parties reserve the right to remove any participant whose conduct is deemed disruptive, unsafe, or in violation of event policies, without refund.

11. WEATHER AND EVENT MODIFICATION

I understand that the event may be delayed, shortened, modified, or cancelled due to weather conditions or other circumstances beyond the control of the organizers. I acknowledge that no refund or compensation shall be provided for event modifications, cancellations, or delays caused by weather, acts of God, or other unforeseen circumstances.

12. REGISTRATION AND ELIGIBILITY

I represent that I am at least 18 years of age (or, if under 18, that my parent or legal guardian has signed below), that I am physically able to participate in the event, and that the registration information I have provided is true and accurate to the best of my knowledge.

13. SEVERABILITY

If any provision of this Waiver and Release is held to be invalid, unenforceable, or illegal by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall remain in full force and effect.

14. GOVERNING LAW AND VENUE

This Waiver and Release shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action arising from this agreement shall be filed in the courts located in Harris County or Montgomery County, Texas.

15. ACKNOWLEDGMENT AND ELECTRONIC SIGNATURE

By checking the box below, typing my name, and submitting my registration, I acknowledge that I have read this Liability Waiver and Release in its entirety, understand its contents, and voluntarily agree to be bound by its terms. I understand that this is a legally binding agreement that waives my right to sue. I further acknowledge that my electronic acceptance, including my typed name, constitutes my electronic signature and carries the same legal force and effect as a handwritten signature under the Uniform Electronic Transactions Act.
